Boston College Chronicle reports that City of Newton plans to seize by eminent domain 17 of the 24 acres BC purchased in 2016 from Congregation Mishkan Tefila for $20m. Newton did not attempt to purchase the parcel when it was for sale in 2016. BC has spent over $5m to refurbish the synagogue building and more than $1.5m to repair a City sewer line. BC has not proposed any development plans for the 17 acre parcel. The Newton Mayor says Newton wants to preserve the natural habitat. I haven't done much eminent domain law, except for public utilities, but I would think it's going to be difficult for the University to successfully oppose the taking.
